Former President Donald Trump has asked the New York Court of Appeals to halt a criminal hush money trial scheduled to begin Monday so he can appeal a lower court's ruling on presidential immunity and ask the judge to recuse himself from the case. They asked for emergency relief.
Wednesday's court filing is the latest in a series of actions by President Trump this week in the appeals court to halt the trial before its scheduled start.
Earlier this week, President Trump's legal team appealed to delay the trial so he could challenge a gag order that barred the former president from speaking about witnesses, the judge's and prosecutor's families, and the jury. requested the court. In a brief two-page notice of petition filed earlier in the day, Trump's lawyers rejected his request to delay the trial until the Supreme Court rules on whether the former president can claim immunity. Judge Juan Melchan, who handed down the decision, said the act exceeded his authority. in an unrelated criminal case related to the 2020 election. Marchan denied the motion, arguing that Trump filed it too late.
The notice also states that President Trump intends to challenge the judge's ability to oversee the trial.
