Spencer Fehn attorney Sean Tuma was a guest on the Feb. 1 episode of the Texas State Bar podcast to discuss important updates in the state's data privacy and cybersecurity regulations.
In the episode “Demystifying the Texas Data Privacy and Security Act,” Sean spoke with host Rocky Diehl about the new Texas law that goes into effect on July 1, 2024. He summarized the elements of this law and how they impact Texas attorney clients. Practice. We also provided security best practices to comply with new regulations.
“The most important thing I can say to Texas lawyers and Texas law firms is that this law is about compliance regarding the processing and sale of consumer personal data. It applies to everyone,” Sean said. He emphasized that regardless of the size of a law firm, “any act that exposes personal information, or faces a data breach, falls within the definition of the Texas Breach Notification Act and must comply with it.”
Sean then explained what the incident response and notification process entails. He emphasized that the Texas Breach Notification Act requires all individuals affected by a data breach to be notified “within 60 days, if all are within the state of Texas.” In Texas he said if more than 250 people are affected, [notify] Notify the Texas Attorney General within 30 days of this decision. ”
